1. Introduction
Welcome to PlateauRouteCommons ("we," "us," or "our"). These Terms & Conditions ("Terms") rule your utilization of our yacht charter offerings and the platform at plateauroutecommons.sbs (the "Service") overseen by PlateauRouteCommons.
By confirming a rental or utilizing our Service, you consent to adhere to these Terms. Should you reject any part of these terms, you are not permitted to access the Service.
2. Service Overview
PlateauRouteCommons offers superior yacht charter services, inclusive of, but not restricted to:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private events
- Multi-day charters
Service availability is dependent on various factors, including but not limited to, weather conditions. We retain the discretion to alter or cease services at will.
3. Booking and Reservations
3.1 Booking Process
To reserve a charter, one must:
- Be no less than 18 years of age
- Present valid and complete details
- Make payment of the necessary deposit as noted in your booking acknowledgment
- Accept these Terms & Conditions
3.2 Confirmation
Confirmation of your booking is realized solely after the payment is received and our written confirmation is provided. Service may be denied to any individual at our discretion.
3.3 Availability
Charter availability is dependent on vessel readiness and appropriate weather conditions. We will strive to accommodate your preferred schedule whenever feasible.
4. Payment Terms
4.1 Pricing
All prices are denominated in € and incorporate all pertinent taxes unless stated otherwise. Price changes may occur without advance notification.
4.2 Payment Schedule
- Deposit: 50% of the total cost of the charter is payable upon booking
- Balance: Due 48 hours prior to the commencement of the charter
- Additional charges (if applicable): Payable at the end of the charter
4.3 Payment Methods
We approve a variety of payment methods, including major credit cards, bank transfers, and certified bank drafts, with secure, encrypted processing systems.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- More than 72 hours prior to departure: Entire refund minus processing fees
- 24-72 hours prior to departure: 50% refund
- Less than 24 hours prior to departure: No refund available
5.2 Weather Cancellations
If the yacht's captain deems weather conditions as perilous, we will propose to:
- Rearrange your charter for another available date without extra expense
- Issue a complete refund if rescheduling proves impracticable
5.3 Mechanical Issues
In case of a mechanical malfunction with the assigned vessel, efforts will be made to present an appropriate replacement. If replacement is not possible, a full refund will be administered.
6. Safety and Conduct
6.1 Safety Requirements
All aboard must:
- Heed all instructions by the crew
- Utilize safety gear as necessitated
- Declare any medical ailments that might jeopardize their wellbeing
- Stay within assigned areas aboard the vessel
6.2 Prohibited Items
Banned from the yacht are:
- Glass containers
- Illegal contraband
- Weapons of any kind
- Excess non-alcoholic beverages beyond reasonable personal consumption
- Pets, except if sanctioned beforehand
6.3 Conduct
Guests are to uphold respectful comportment. A charter can be terminated prematurely with no refund provided if a guest's conduct endangers safety or disrupts others' enjoyment.
7. Liability and Insurance
7.1 Our Liability
Our liability is capped at the charter fee paid by you. We are not accountable for:
- Injuries emanating from personal negligence
- Loss or damage to personal possessions
- Indirect, consequential, or punitive damage claims
- Delays induced by inclement weather or factors beyond our control
7.2 Insurance Coverage
We possess comprehensive marine insurance for our fleet and activities. It is your responsibility to secure personal and travel insurance.
7.3 Assumption of Risk
By engaging in our services, you recognize that oceanic endeavors come with intrinsic risks and you accept liability for your personal security and welfare.
8. Modifications and Itinerary Changes
Itinerary, path, or timetable modifications may be effected based on meteorological terms, safety needs, or operational imperatives. We will aim to offer comparable alternatives where required.
9. Force Majeure
We absolve responsibility for postponements, cancellations, or alterations caused by forces beyond our will, such as, but not confined to:
- Severe weather contingencies
- Natural catastrophes
- Government directives
- Port restrictions
- Technical failures
10. Privacy and Data Protection
Your private data is managed consistent with our Privacy Policy. By employing our offerings, you assent to the collection and employment of your data as outlined within our Privacy Policy.
11. Intellectual Property
All constituents on our platform, such as text, visuals, trademarks, and photos, are defended by copyright and trade laws. Unauthorized reproduction, distribution, or adaptation requires our written consent.
12. Governing Law
The laws of Monaco dictate these Terms. Any disputes shall be settled in the courts of Monte Carlo, Monaco.
13. Changes to Terms
We retain the right to alter these Terms when needed. Amendments will be broadcasted on our site with a new revision date. Continued use of our services implies acceptance of the revised terms.
